ELECTRONIC TRANSACTIONS PERMISSION AGREEMENT

This agreement seeks your permission to communicate with you electronically, by email and/or fax and/or SMS.

This agreement is for website visitors who are wanting a loan, who may provide information for referral and expect and need a response by email, fax or SMS. This agreement is mandatory under the Electronic Transactions Act 2009 and the National Consumer Credit Protection Regulations 2010, No. 4, in order for Action Cash Loans Centres to legally respond to you.

The parties hereby agree to the electronic creation and communication of documentation, as between them, and as may be required by legislation and regulation and/or commercial practice, from time to time and where relevant. This including, but not limited to, credit guides, quotations, credit proposal disclosure documents, pre-contractual statements and credit contracts (the last two may be the same document in part or whole) and all manner of other relevant business communications.

The consumer hereby agrees to the electronic creation and communication of that documentation, as between the consumer and any franchisee, being a licensed credit provider, or authorised credit representative of a licensed credit provider, being part of the Action Cash Franchise group and as represented on this website by Action Cash Franchise Pty Ltd.

Terms and Conditions

The consumer hereby agrees that:

  1.  permission is granted for information to be transferred to them by the Authorised Credit Representative and/or Credit Provider (as relevant) by electronic means including, but not limited to, email and fax;
  2. at the time of entering this contract, any information electronically transferred to the consumer, by the Authorised Credit Representative and/or Credit Provider, to the electronic address/es provided by the consumer/s and listed in this contract, will be readily accessible for subsequent reference;
  3. the signature or identifier used by the Authorised Credit Representative and/or Credit Provider, in any such communication, will reliably identify the Authorised Credit Representative and/or Credit Provider and will be accepted by the consumer/s as the signature or identifier of the Authorised Credit Representative and/or Credit Provider;
  4. the consumer will accept scanned paper documents included in any electronic communication, as if they were hard copies; and
  5. at the time of entering this contract, such scanned paper documents will be filed electronically, so that they are retrievable for later reference from the consumer/s system;
  6. receipt of such electronically transferred communication is deemed to be when the message enters the system;
  7. they will regularly check their system for electronically transferred communications;
  8. at the time of entering this contract, any electronic communication received by the consumer/s’ system can be printed and kept in storage in hard copy, or kept on file in electronic format;
  9. they accept that communications capable of being legally transferred electronically, by the Authorised Credit Representative and/or Credit Provider, will no longer be available in hard copy or print;
  10. they will provide 24 hours’ notice should they choose to withdraw permission for the Authorised Credit Representative and/or Credit Provider to communicate electronically;
  11. they accept that the inclusion of the above terms in this contract constitutes notice in writing to the Authorised Credit Representative and/or Credit Provider;
  12. they will inform the Authorised Credit Representative and/or Credit Provider of any change to their system’s capabilities during the term of this contract, as may reasonably interfere with one or more of the above provisions, as soon as reasonably practicable, to ensure effective electronic communications between the parties to this contract.

The Consumer/s further agree that:

  1. their permission to accept electronically transferred communications may be withdrawn at any time;
  2. it is the responsibility of the consumer/s, at the time of entering this contract, to confirm that their system has the capabilities listed above;
  3. the Authorised Credit Representative and/or Credit Provider is not liable for any damage whatsoever, caused directly or indirectly by the failure of the consumer/s to advise the Authorised Credit Representative and/or Credit Provider, during the term of the loan, of any problem with their system that precludes any of the above from successfully occurring; and
  4. the Authorised Credit Representative and/or Credit Provider is not liable for any damage whatsoever caused directly or indirectly, due to the failure of the consumer/s to rectify the problem with their system occurring during the term of the loan, that precludes any of the above from successfully occurring.

On behalf of Action Cash Loan Centres, the Action Cash Franchise hereby agrees that:

  1.  Action Cash Loan Centres will provide the consumer with the ability to retrieve the relevant document, including disclosure documents, by electronic means;
  2. any document sent shall be in a format that allows it to be saved to an electronic file and to be printed;
  3. for any document sent by, or made available on, the system of the Action Cash Loans Centre credit provider or authorised credit representative, at the time of sending or availability, it is reasonable to expect the consumer to be able to save it on electronic file and print it;
  4. the Authorised Credit Representative and/or Credit Provider will provide prompt notice that the information is available to the consumer/s and such notice shall specify the nature of the communications; and
  5. the transferred information will be on the Authorised Credit Representative and/or Credit Provider’s system for a reasonable time and capable of transfer and download to a file for storage and later retrieval by the consumer/s.
